The Law on Employee Benefit Exemption has been approved by the employer for 5 people in 1362to support manufacturing, technical and industrial workshops in order to support domestic production, although the number of workshops is reduced every day The purpose of this paper is to express the right and duty for eliminating discrimination, protecting the domestic economy and Premium Unification the premium rate in all workshops. حق برخورداری ازتامین اجتماعی به عنوان یک حق اساسی وبنیادین به منظور تامین منافع اشخاص درزندگی فردی واجتماعی مورد شناسایی واقع شده است درمقابل دولتها ،نیز وظیفه اجرای تحقق این حق رابه عهده دارند . نظام تامین اجتماعی جمهوری اسلامی ایران بر اساس قانون ساختارنظام جامع رفاه وتامین اجتماعی در سه حوزه بیمه ای ،حمایتی وامدادی درحال اجراست. در بخش بیمه ای ودرقالب نظام مشارکتی باپرداخت حق بیمه سهم کارفرمایان،کارگران و دولت در راستای اجرای اصل 29قانون اساسی سازمان تامین اجتماعی نقش اساسی دارد . قانون معافیت پرداخت حق بیمه سهم کارفرما به میزان 5نفر درسال 1362 ازمواردی است که به منظور حمایت ازکارگاههای تولیدی ،فنی وصنعتی به تصویب رسیده ودرحال اجراست.امابه لحاظ بار مالی ودلایل مختلف ازتعداد کارگاههای مشمول کاسته می شود. نوع نگاه قانون اساسی ،قوانین عادی وقانون ساختار متفاوت از کاهش معافیتها وحذف می باشد .در این نوشتارهدف ؛ تکلیف دولت در راستای رفع تبعیض و رعایت اصل برابری و مولفه اخلاق دریکسان سازی نرخ حق بیمه تمام کارگاههای صنفی می باشد http://akhlagh.saminatech.ir/fa/Article/Download/17901
