Generally, partition refers to the difference between multiple joint partners, while separation means separating a property or land by the owner. In other words, when the partners do not agree on how to divide the joint property, the solution is to request partition. However, in the case of separation, a person can also take action to separate their own land or property. In this research, we intend to focus on the concepts of partition and separation and compare them from the perspective of property registration law.</p> <p>تفکیک، افراز و تقسیم هر کدام تعریف مخصوص به خود را داشته و با هم متفاوت می باشند. بطور کلی می توان گفت افراز یعنی اختلاف بین چند شریک مشاعی است اما تفکیک به معنای جدا کردن ملک و یا زمین توسط مالک می باشد و به عبارتی جایی که شرکا، اتفاق نظر در نحوه تقسیم ملک مشاعی نداشته باشند، چاره کار درخواست افراز است اما در موضوع تفکیک اینطور نبوده شخص میتواند نسبت به تفکیک زمین و یا ملک خود نیز اقدام نماید. در این پژوهش قصد داریم که به مفهوم افراز و تفکیک و مقایسه آنها از منظر حقوق ثبت بپردازیم.</p> http://law.ahrar.ac.ir/en/Article/Download/45965
