In this regard, seven tactics have been analyzed, including: structural transparency, meritocracy in the selection of judicial leaders, focus on macro-level policymaking and delegation of executive matters, control and management of resources, institutional cohesion, equitable distribution of resources and human capital, and the training of competent human resources as the pillars of sustainable justice. The findings of the study show that each of these principles is rooted in recognized jurisprudential rules such as <em>Hifz al-Nizam</em> (Preserving the system), <em>Adā' al-Amānāt</em> (Fulfilling trusts), <em>Nafy Sabeel</em> (Denial of domination), <em>Lā ḍarar</em> (No harm), and <em>Ma Lā Yatimm al-Wājib Illā Bihi Fahuwa Wājib</em> (What is necessary for the completion of a duty is itself a duty), and are considered as secondary laws in Sharia. The analysis of Qur'anic verses and Hadiths indicates that the realization of judicial justice is impossible without institutionalizing these tactics. Shia jurisprudence, with reliance on <em>Wilayah</em> (leadership), justice, and order, has the capacity to provide a comprehensive model of Islamic judicial governance that is both rooted in religious legitimacy and responsive to contemporary managerial requirements.</p> <p>این پژوهش با هدف تبیین مبانی فقهی حکمرانی قضایی در اسلام و استخراج تاکتیک های آن بر پایه&zwnj;ی فقه امامیه انجام شده است. در این راستا، هفت تاکتیک شامل: شفافیت ساختاری، شایسته&zwnj;سالاری در انتخاب رهبران قضایی، تمرکز بر سیاست&zwnj;گذاری کلان و تفویض امور اجرایی، کنترل و مدیریت منابع، انسجام نهادی، توزیع عادلانه&zwnj;ی منابع و نیروی انسانی، و تربیت نیروی انسانی شایسته، به&zwnj;عنوان ارکان عدالت پایدار تحلیل گردیده&zwnj;اند. نتایج تحقیق نشان می&zwnj;دهد که هر یک از این اصول ریشه در قواعد معتبر فقهی چون <em>حفظ نظام، أداء الأمانات، نفی سبیل، لاضرر، و ما لا یتمّ الواجب إلا به فهو واجب</em> دارند و از احکام وضعی شریعت محسوب می&zwnj;شوند. تحلیل آیات و روایات بیانگر آن است که تحقق عدالت قضایی بدون نهادینه&zwnj;سازی این تاکتیک&zwnj;ها ممکن نیست. فقه امامیه با اتکای بر ولایت، عدالت و نظم، توانایی ارائه&zwnj;ی الگوی جامع حکمرانی قضایی اسلامی را دارد که هم بر مشروعیت دینی استوار است و هم پاسخ&zwnj;گوی الزامات مدیریتی معاصر می&zwnj;باشد.</p> http://aujsas.ir/ar/Article/Download/52336
